Article 2: Price
All prices stated are expressed in EURO, excluding VAT and all other taxes or duties to be borne by the Customer.
If delivery, reservation or administration costs are charged, this will be stated separately.
The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.
Article 3: Offer
Despite the fact that the online catalog and e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind DE WITTE NV. DE WITTE NV is only bound by a best efforts obligation as to the accuracy and completeness of the information offered. DE WITTE NV is in no case liable in case of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service department in advance through the contact options on our website.
The offer is always valid while supplies last and may be modified or withdrawn by DE WITTE NV at any time. DE WITTE NV cannot be held liable for unavailability of a product.
Article 4: Online purchases
Once in the shopping cart, the customer is notified of what was just added. If the customer has a coupon code, he/she can also enter it here and it will be automatically deducted from the total amount. The customer enters the billing information. The customer can also enter a different delivery address. The customer must enter the desired address to correctly complete the order and delivery. Shipping is done by an external carrier. The customer can find these shipping costs in the overview in the shopping cart under “Shipping: (Delivery)”. The customer can also add a comment if desired. The customer now sees the total amount to be paid. This amount includes VAT. After this, the customer chooses the desired payment method. For this he/she has the choice between: Credit Card (MasterCard, American Express or Visa), Bancontact, iDeal or direct bank transfer. Any additional costs due to the payment method will be listed, unless DE WITTE NV assumes the costs.
The customer must check the box (OPT-IN) where he/she declares to have read and agreed to the General Terms and Conditions of THE WHITE SA. The customer can review the Terms and Conditions by clicking on the link. The customer can now click on the 'Checkout' button. If certain fields are not or incorrectly filled out, they will receive a red error message. The customer should resolve these error messages first before clicking 'Continue' again. The customer will now receive an order confirmation by email.
DE WITTE NV is entitled to refuse an order due to a serious deficiency of the Customer regarding orders involving the Customer.
Article 5: Delivery and execution of the contract
Once the order was created by the customer, DE WITTE NV is notified so that the order can be prepared for transport as soon as possible. The customer then receives an email saying that we have received the order and that we are preparing it for shipment. As soon as the order has been shipped, the customer will receive a notification via e-mail that his/her order has been shipped. Delivery time depends on the external carrier. We strive for a delivery time of 5 working days. However, this is not a guarantee. DE WITTE NV cannot be held responsible for late delivery.
Deliveries outside Belgium are not possible for the time being.
Any visible damage and/or qualitative deficiency of an item or other shortcoming in the delivery must be reported by the Customer to DE WHITE SA without delay and immediately, within 24 hours.
Placing the goods is equivalent to accepting the goods. Once the goods have been placed, they cannot be returned.
Risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, risk already passes to the Customer upon delivery to the carrier, if the carrier was instructed by the Customer to transport the goods and this choice was not offered by THE WHITE SA.
Article 6: Retention of title
The purchased items remain the exclusive property of DE WHITE SA until full payment by the Customer. The Customer agrees to notify third parties of DE WHITE NV's retention of title if necessary, e.g. anyone who would come to seize items not yet fully paid for.
Article 7: Right of withdrawal
The provisions of this article apply only to Customers who purchase items online from DE WITTE NV in their capacity as consumers. The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons. The withdrawal period shall expire 14 calendar days after the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the last good.
To exercise the right of withdrawal, the Customer must notify DE WITTE NV, located at 9230 WETTEREN, Oosterzelesteenweg 123, VAT BE 0400.141.331, RPR GENT AFDELING DENDERMONDE, info@bouwdeal.be, +32 9 365 64 87, of his decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post, fax or e-mail). The Customer may use the model withdrawal form for this purpose, but is not obliged to do so. This form can be found on the “right of withdrawal” link at the bottom of the website. To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to DE WITTE NV, Oosterzelesteenweg 123, 9230 WETTEREN, without delay and in any case not later than 14 calendar days from the day on which he communicated his decision to withdraw to DE WITTE NV. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct cost of returning the goods shall be borne by the Customer.
If the returned item is somehow reduced in value, DE WHITE SA reserves the right to hold the Customer liable and claim compensation for any reduction in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods. Only items in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.
If the Customer withdraws from the contract, DE WHITE SA will refund all payments received from the Customer up to that point, excluding standard delivery costs, to the Customer within a maximum of 14 calendar days after DE WHITE SA has been notified of the Customer's decision to withdraw from the contract. For sales contracts, DE WHITE SA may wait to refund until it has received all goods back.
DE WITTE NV will refund the Customer by bank transfer to the account number chosen by the Customer. In any case, the Customer will not be charged for such refund.
If goods have been removed from their packaging and have been used, for example, returns are no longer possible (see also Article 5).
Article 8: Warranty
Pursuant to the applicable legislation on consumer protection in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.
To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer's home, the Customer must contact DE WHITE SA customer service and return the item to DE WHITE SA at his expense.
If a defect is detected, the Customer must notify DE WHITE SA. In any case, any defect must be reported by the Customer within 24 hours after delivery. Thereafter, any right to repair or replacement expires.
The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 2 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10: Penalties for non-payment
Without prejudice to the exercise of other rights available to DE WITTE NV, in case of non-payment or late payment, the Customer is automatically and without formal notice liable to pay interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer shall be liable, by operation of law and without formal notice, to pay a fixed indemnity of 10% on the amount in question, with a minimum of €25 per invoice. Without prejudice to the foregoing, DE WHITE SA reserves the right to take back items not (fully) paid for.

Article 12: Impairment of validity - non-derogation
If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.
The failure at any time by THE WHITE SA to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of these Terms.
Article 13: Modification of conditions
These Conditions are supplemented by other conditions explicitly referred to and the general conditions of sale of DE WHITE SA. In case of contradiction, these Terms and Conditions shall prevail.
Article 14: Proof
The Customer accepts that electronic communications and backups may serve as evidence.
Article 15: Applicable law - Competent court
Belgian law is applicable, with the exception of the provisions of international private law on applicable law and with the exception of the Vienna Convention on Contracts for the International Sale of Goods. Unless the Customer is a consumer, the courts of the district of GENT AFDELING DENDERMONDE shall have exclusive jurisdiction in any disputes.
Article 16: General provisions
The e-commerce website of DE WITTE NV, an NV with registered office located at 9230 WETTEREN, Oosterzelesteenweg 123, VAT BE 0400.141.331, RPR GENT AFDELING DENDERMONDE, (hereinafter referred to as “DE WITTE NV”) offers its customers the possibility to purchase the products from its online store online. These General Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor to this e-commerce website (“Customer”).
When placing an order through DE WHITE SA's online store, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted by DE WITTE NV.
Article 17: Conditions refund difference on best pallet prices
The price guarantee applies to identical items (brand/manufacturer, etc.).
It concerns the same pallet quantity.
The product must be in stock and deliverable within 5 working days from our competitor.
The price applies to everyone, without additional conditions. E.g. obligation to purchase another product, membership, ...
The price guarantee does not apply to special, limited lots, opening offers, special deals or bargains.
The competitor's price must be provable by a link to a web page or a scan of an advertising flyer.
The lower sales price must be verifiable; you must be able to provide us with valid proof of this.
Article 18: Uncollected orders
For orders that have not been picked up or delivered more than 3 months after the order date, STOCAGE CHARGES of € 15/pallet space/month will be charged.
Article 19: Security bags and pallets
WARRANTY bags and pallets will be charged and refunded at the same price if they are returned by the customer in good condition within 3 months of the delivery date. Under no circumstances will they be collected by us at the yard unless in the case of simultaneous new deliveries at the same yard address. The number of deposit pallets is always settled on the sales invoice.
Article 20: A breakage rate of 3% is considered acceptable on building materials.
